GENERAL TERMS AND CONDITIONS OF SALE – WINSOME DESTINATION

1. Definitions

Owner / Principal: the owner of the furnished tourist accommodation who has entrusted Winsome Immobilier with the seasonal rental management of the property.

Agent / Mandatary: SAS WINSOME IMMOBILIER, acting on behalf of the Owner under a property management mandate.

Host: SAS WINSOME IMMOBILIER (operating under the brand Winsome Destination) acting as intermediary and manager of the seasonal rental towards the Traveler.

Traveler or “you”: the person(s) who have booked a furnished rental through Winsome Destination.

Management Mandate: the contract entered into between the Owner and Winsome Immobilier for the seasonal rental management of the accommodation.

Booking Contract (“Contract”): the agreement concluded between the Traveler and Winsome Destination, formalized by the booking confirmation and its appendices (including these General Terms, the digital welcome guide, and the house rules).

Accommodation / Furnished Tourist Rental: the property rented for the duration of the stay.

Platforms: third-party booking websites (such as Airbnb, Booking.com, etc.) and Winsome Destination’s own booking channels.

2. Purpose

Winsome Immobilier carries out seasonal rental management activities. Acting as Agent for Owners, it offers Accommodations for rental to Travelers and enters into a Contract for each reservation which defines the rights and obligations of the parties. These General Terms apply to all bookings made via Platforms or direct channels and are made available to the Traveler prior to booking confirmation.

4. Essential Obligations

Traveler Obligations: pay the price and related fees on time; complete online check-in when requested; respect the maximum occupancy; use the Accommodation responsibly; comply with house rules, neighbors and building regulations; allow necessary technical interventions; return keys in accordance with instructions; complete the check-in/check-out inventory when required.

Host Obligations: ensure access to the Accommodation as per the Contract; ensure the property is cleaned prior to arrival; organize maintenance or technical interventions when necessary to ensure the proper conduct of the stay.

5. Booking and Contract Formation

The Traveler selects dates, confirms the booking, provides personal details and payment information. Acceptance of these Terms is required at the time of booking. The booking becomes final once written confirmation has been issued (email/platform) and, where applicable, once payment of the deposit or balance has been made in accordance with the booking conditions.

6. Prices, Fees and Rate Fluctuation

Prices are indicated in euros, inclusive of applicable taxes, excluding tourist tax. Rates are dynamic and may vary depending on demand, seasonality, events or booking date. Cleaning and linen fees, optional services and tourist tax are detailed before payment. Any additional service requested during the stay is billed separately.

7. Payment, Deposit/Balance and Non-Payment

Payment conditions (deposit, balance and deadlines) are indicated during booking. Failure to pay on time may result in cancellation of the reservation in accordance with the termination clause (Article 23), without refund, except where cancellation policies expressly provide otherwise.

8. Security Deposit (Bank Authorization Hold) and Damages

A security deposit in the form of a bank authorization hold may be required to cover potential damages, key loss or breach of house rules. The amount and conditions (timing, duration, release) are indicated in the Booking Contract and/or digital welcome guide. Failure to secure the deposit may result in denied access to the Accommodation without refund.

9. Maximum Occupancy and Registered Guests

The maximum occupancy is stated in the Booking Contract. Any excess occupancy without prior written approval from Winsome is prohibited and may result in removal of unauthorized occupants, application of additional fees and collection of corresponding tourist tax. The number of guests declared must be accurate and updated prior to arrival.

10. Noise, Neighbourhood Respect and Parties

To respect the neighborhood and building regulations, loud noise, parties and disruptive behavior are strictly prohibited. In case of violation, Winsome may send security personnel and/or call law enforcement. Intervention fees and any penalties imposed by the building may be charged to the Traveler. Severe violations may result in immediate termination of the stay without refund.

11. Access, Check-In and Check-Out

Access instructions (address, entry codes, key retrieval) are provided via the digital welcome guide once conditions of access have been fulfilled (payment, security deposit, online check-in). Early arrival or late departure is subject to prior approval and may incur additional charges. Keys must be returned as instructed; failure to do so may result in additional fees.

12. Inventory and Condition Report

An inventory may be required upon arrival and departure (digital module, photos, listed items). Any irregularity must be reported within a reasonable timeframe. If no issue is reported, the Accommodation is deemed to be in good condition. Winsome conducts a post-stay inspection. Damages or missing items may result in charges against the security deposit.

13. Cleaning, Linen and Guest Responsibilities

Accommodation is cleaned prior to arrival. Mid-stay cleaning is not included unless expressly booked. Before departure, the Traveler must leave clean dishes, empty the refrigerator, dispose of waste, turn off lights/air-conditioning and close windows/doors. Additional cleaning required beyond normal use may be billed.

14. Additional Services and Extras

Optional services (additional cleaning, baby equipment, extra linen, transport arrangements, etc.) may be offered depending on availability and at extra cost. These services may be provided directly by Winsome or third-party partners.

15. Tourist Tax

Tourist tax applies according to the local regulations of the municipality where the Accommodation is located. The tax is collected by Winsome on behalf of the local authority and is indicated before payment.

16. Reasonable Use of the Property

The Traveler agrees to use the Accommodation responsibly, respect energy-saving instructions (e.g., air-conditioning must not operate with windows open), and follow safety instructions relating to the property and amenities (e.g., swimming pool, terraces, gardens).

17. Internet / Wi-Fi, TV and On-Demand Content

Wi-Fi is provided for reasonable and lawful use. Illegal downloading or streaming is prohibited. Winsome does not guarantee uninterrupted service and does not support personal device configuration. The Traveler may not subscribe to paid TV or VOD services; any such charges and restoration costs will be billed to the Traveler.

18. Essential Safety Equipment

Accommodations meet applicable safety requirements (smoke detector; pool safety devices where relevant). Usage instructions are provided in the welcome guide and must be respected.

19. Technical Interventions and Access

Winsome may carry out essential maintenance and technical interventions (including pool, garden, spa maintenance) during the stay. The Traveler cannot prevent necessary or scheduled interventions but will be informed beforehand when possible.

20. Claims and Assistance

Assistance contact information is provided in the digital welcome guide. The Traveler must promptly report any issue and allow access for resolution. If access is refused, no compensation may be claimed. Formal claims may be sent to contact@winsome-immobilier.com with supporting evidence.

21. Cancellation and Postponement

Cancellation terms depend on the conditions specified on the Platform or direct booking channel used. Non-refundable offers do not allow any refund regardless of reason. For bookings made through third-party Platforms, their cancellation policies prevail. In certain exceptional situations (e.g., official travel restrictions), postponement or credit may be offered if expressly indicated. Optional travel/cancellation insurance, when available, is contracted directly between the Traveler and the insurer.

22. No Right of Withdrawal

Under Article L.221-28 of the French Consumer Code, the legal right of withdrawal does not apply to accommodation services provided on specific dates. The Traveler must refer to the cancellation conditions in Article 21.

23. Termination Clause

In the event of late payment, failure to complete required check-in steps, failure to secure the deposit, or serious breach of house rules, the Contract may be terminated after a 48-hour notice without effect, without refund of unused nights and without prejudice to damages.

24. Liability

Winsome acts as Agent for the Owner. Winsome is not liable for structural or regulatory defects attributable to the Owner, nor for damages caused by the Traveler or third parties. Winsome’s liability is limited to direct and foreseeable damages resulting from a proven contractual breach.

25. Personal Data

Processing of personal data is described in the Winsome Immobilier Privacy Policy available on the website. The Traveler has the right to access, correct, delete or oppose the processing of their personal data where applicable. Contact: contact@winsome-immobilier.com.

26. Consumer Mediation

If a complaint remains unresolved, the Traveler may refer the matter to the French consumer mediator:

27. Force Majeure

No party is liable for failure to perform due to force majeure events (natural disasters, war, riots, epidemics, administrative prohibitions, etc.). If such an event lasts more than one month, either party may terminate the Contract with 30 days’ notice.

28. Assignment

Winsome may transfer its rights and obligations in the context of business restructuring (sale, merger, transfer of assets). The assignee will then assume the same obligations. The Traveler will be informed.

29. Severability

If any provision is held invalid, the other terms remain in effect. The parties will replace the invalid clause with a valid one closest to the original intent.

30. Governing Law and Jurisdiction

These Terms are governed by French law. In the absence of amicable resolution or mediation, disputes fall within the jurisdiction of the courts within the jurisdiction of the Aix-en-Provence Court of Appeal (notably the courts of Grasse), subject to consumer protection rules.

Check-in/check-out times, security deposit amounts depending on the property type, early check-in and late check-out fees, cleaning and damage fee schedules, and house rules specific to each apartment or villa are detailed in the Booking Contract and the digital welcome guide. In the event of any discrepancy, the specific conditions provided at the time of booking shall prevail over these General Terms and Conditions.
